Access rights uk?

On are deeds it say's that the house next door.has access down the side of our house right through are garden. on the deeds it say's they can go through by foot or wheel barrow. which is a very old deed.we would like to get this changed as they're using it for a bike 3 to 4 times daily and for the bin's and leaving often times the bike down the side on are land so we can't get by. we have spoke with them and they're not going to give up the access. we have 3 dogs and even the gate is left undone. help at my wits end must be somthing i can do. no silly answers.

Hi delicia. this is called an easement. if this is registered on the register of land charges you need to get it removed. the problem you might have is if it grants access to land that belongs to them that would otherwise be landlocked, in other words the alley is the only access. this might have been the case man y years ago but development of the land may have changed the layout so that there is no need for the easement to exist any longer. there's exceptions that could complicate the's sue so you need to speak to a land/property law specialist solicitor. hope this helps nice luck
